Fortas, Abe

(19 jun. 1910, Memphis, Tenn., EE.UU.–6 abr. 1982, Washington, D.C.).

Jurista estadounidense. Se graduó en la escuela de derecho de la Universidad de Yale (1933), donde estudió con William O. Douglas antes de seguirlo al Securities and Exchange Commission (SEC). Como cofundador de un importante estudio de abogados en Washington, D.C. (1946), representó a algunas de las empresas más grandes de EE.UU. En 1963 defendió con éxito el caso Gideon v. Wainwright, en el que se estableció el derecho a asesoría legal del inculpado (ver derechos del inculpado) en juicios criminales, independientemente de su capacidad de pago. El pdte. Lyndon B. Johnson, amigo cercano suyo, lo designó para un puesto en la Corte Suprema de los Estados Unidos de América en 1965. Johnson intentó elevarlo al cargo de presidente de la Corte en 1968, pero su nombramiento se vio enfrentado a actitudes obstruccionistas en el Senado, y Fortas solicitó que su nombre no fuera tomado en consideración. En 1969, Fortas renunció a la Corte ante la amenaza de ser acusado constitucionalmente en razón de sus tratos con un financista que fue posteriormente encarcelado por infracciones a la ley de valores.
